Grubhub Insurance Issues for Chicago Drivers and Injury Victims

A Chicago lawyer can help when Grubhub insurance questions start blocking recovery

After a car accident, Grubhub insurance issues can create problems before an injury claim ever gets moving. Many people assume delivery app companies insure their drivers the same way. Grubhub does not. Its current Delivery Partner Agreement says drivers using a motor vehicle must carry their own vehicle insurance, and it warns that a personal auto policy may not cover liability, collision, medical payments, uninsured motorist, underinsured motorist, or other losses while the driver is providing delivery services.

That is why these cases can become insurance fights so quickly. A person injured in a Grubhub crash may assume the company will cover the loss. A Grubhub driver may assume a personal insurer will treat the crash like ordinary driving. Grubhub’s own materials warn that delivery work can create coverage gaps, which means the real question is often not whether insurance exists, but which insurance actually applies.

Keating Law Offices, P.C. knows how to deal with that kind of dispute. Founded in 2008 by Attorney Michael Keating, our firm has helped hundreds of injured clients recover compensation – including $1 million for a bicyclist injured in a training ride. We know how to build claims insurers have to take seriously. If Grubhub insurance issues are standing between you and recovery, a Chicago Grubhub accident lawyer at Keating Law Offices can investigate the crash, identify the available coverage, and fight for the compensation you should be getting.

Does Grubhub require insurance?

Yes. Grubhub says a delivery partner who uses a motor vehicle must maintain vehicle insurance for every vehicle used to perform delivery services. The agreement also says that coverage must apply to activities arising in connection with delivery services, must satisfy state and local legal requirements, and must be produced if Grubhub asks for proof of insurance.

That matters in Illinois because state law requires minimum liability coverage of $25,000 for bodily injury to one person, $50,000 for bodily injury per crash, and $20,000 for property damage. Illinois also requires uninsured motorist bodily injury coverage at the legal minimum. In a serious Grubhub crash, those limits may not go very far.

So yes, Chicago Grubhub drivers need car insurance if they are making deliveries by motor vehicle. But the existence of a policy doesn’t mean the claim will be simple, and it doesn’t mean the available limits will cover the full loss. That is one reason these cases often require the right lawyer early.

Does Grubhub provide auto insurance?

Not in the broad way many people assume. Grubhub’s current agreement places the insurance burden on the driver, not on a broad automatic company-paid auto liability policy. The same agreement warns drivers that their personal policy may not cover delivery-related losses while they are working.

That is the core Grubhub insurance problem. People hear “delivery app” and expect company coverage to be there. Grubhub’s own documents point in a different direction. They tell drivers to carry their own insurance and warn that personal coverage may not do everything a driver expects when the vehicle is being used for deliveries.

That doesn’t mean there is no claim. It means the insurance analysis has to be done carefully. A good lawyer looks past the first denial, the first excuse, and the first policy an insurer points to.

What Grubhub occupational accident coverage does and doesn’t do

Grubhub says delivery partners have access to occupational accident coverage for injuries suffered while making deliveries. Grubhub also says it’s not an insurance provider and that any coverage is still subject to the policy’s terms, conditions, limitations, and exclusions.

What it does

  • Help with medical expenses if the delivery partner is injured while making a delivery.
  • Help with lost income if the delivery partner is injured while making a delivery.
  • Apply only while the driver is actively engaged in a delivery, which Grubhub defines as the period from accepting the offer until the order is delivered or canceled.
  • Apply to delivery partners, with Grubhub stating that as of January 1, 2024, all delivery partners are eligible, subject to the policy terms.

What it doesn’t do

  • It doesn’t replace auto liability coverage for a person injured by a negligent Grubhub driver. Grubhub describes this as occupational accident coverage for the delivery partner’s own injuries, not broad company-paid liability coverage for third-party claims.
  • It doesn’t cover damage to the driver’s vehicle.
  • It doesn’t apply outside the active delivery window. If the driver isn’t in the period between accepting the offer and delivering or canceling the order, this coverage doesn’t apply.
  • It doesn’t cover injuries that happen while making deliveries for another company.

That distinction matters. This coverage may help an injured Grubhub driver with some losses, but it doesn’t answer every insurance question after a Chicago crash. That is one reason these cases often need the right lawyer early.

Which insurance may apply after a Grubhub crash

The answer depends on who was hurt, who caused the crash, and whether the insurer is trying to deny coverage. In many Grubhub cases, more than one source has to be examined before the full insurance picture becomes clear.

The most common possibilities are:

  • The driver’s personal auto policy: If a Grubhub driver caused the crash while delivering by car, this is often the first policy examined. Grubhub requires the driver to maintain that insurance, but it also warns that personal coverage may not apply fully during delivery work.
  • Another driver’s liability insurance: If someone else caused the crash and injured a Grubhub driver, a Grubhub courier, a pedestrian, or another motorist, the at-fault driver’s policy may be the main source of recovery.
  • Uninsured or underinsured motorist coverage: This can matter when the liable driver has no insurance, too little insurance, or a delivery-use dispute creates a coverage gap. Illinois requires uninsured motorist bodily injury coverage at the legal minimum.
  • Occupational accident coverage: If the injured person was the Grubhub delivery partner, Grubhub says this coverage may help with medical expenses and lost income while the driver was actively engaged in a delivery. It doesn’t replace auto liability coverage and doesn’t cover vehicle damage.
  • A closer look at Grubhub’s role: In some cases, the company’s role may need to be examined instead of accepting the first insurance answer at face value.

That is why these cases shouldn’t be reduced to one insurance card and one phone call. Keating Law Offices knows how to identify every available source of insurance and build the claim around the facts that matter.

What to do when an insurance problem starts

The first few days after a crash matter because insurance companies begin evaluating the claim immediately. Missing records and missing proof can weaken the case before it’s fully understood.

The most important steps are:

  • Get medical care: Your health comes first, and the records help support the claim.
  • Call police: The report should identify that the crash involved a Grubhub driver or courier.
  • Get insurance information: Every available policy matters in these cases.
  • Save app and delivery evidence: Order status, timing, and screenshots may matter when coverage is disputed.
  • Don’t assume the first insurance answer is correct: Early denials and quick explanations are common in complicated delivery cases.
  • Call the right lawyer: Early legal help can protect the evidence and the value of the claim.

That last step matters most. A Grubhub insurance problem is usually not just about one policy. It’s about figuring out what coverage exists, what coverage is being denied, and what has to be done to get the claim moving.

Why the right lawyer matters in Grubhub insurance cases

Grubhub insurance cases can involve denied claims, coverage gaps, occupational accident issues, and disputes over which policy actually applies. An injured person shouldn’t have to untangle that alone.
